Default Judgment Motion Response
Summary
A motion to set aside a default judgment requires the defendant to show valid reasons for their absence, such as lack of notice or excusable neglect. To respond, review the motion, draft a response refuting their claims, and file it with the court. Emphasize any breach of contract or fraudulent behavior by the defendant. Consider consulting a local attorney for assistance in drafting a comprehensive response.Full Conversation
In st clair co Illinois I was awarded a default judgement . The defendants attorney filed a motion to set aside and they have in their motion that defendant was defaulted through no fault of its own. Is that an excuse ? what does that mean and how do I file a response to that motion. what would I say ?
Hi Vickie! It sounds like the defendant's attorney is arguing that the default judgment should be set aside because the defendant was not at fault for missing the court date or failing to respond.
To respond to a motion to set aside a default judgment, you generally need to:
*. Review the Motion: Understand the reasons they provided.
*. Draft a Response: Clearly state why the default judgment should not be set aside.
*. File the Response: Submit it to the court and serve a copy to the defendant’s attorney.
