It has no absolutely merit in a seriously informed statistic assertion. NONE. I show SCOTUS FOLLY in that aspect of their decision. Hence, FOLLY enough to throw out Twombly ! That's not all ! (*) SCOTUS' reference to the difficulty in comprehending "False Positives" was a DISMISSIVE AND IGNORANT mockery on their part. AS another noted, WHY DIDN'T SCOTUS CALL IN STATISTICAL EXPERTS ?? Instead they A DELIBERATE CHOICE TO BASE A NEW PLEADING STANDARD FOUNDED UPON their 'impressions" of Possible, Probable, Plausible and landed on Plausible, apparently whimsically, as a suitable descriptive for the Twombly Pleading as a suitable replacement for Notice Pleading.
