In Custody
I'm sorry to hear about your partner's situation. Your concerns seem to be around:
*. The legality of the arrest and the search of your bags.
*. The lack of reading the Miranda rights.
*. The past charges against your partner.
Here are some legal points to consider:
- If you believe there was no probable cause for the arrest, it may be possible to challenge it in court.
- Miranda rights should be read when a person is in custody and being interrogated. If they weren't, any statements made might be inadmissible in court.
- Past charges can influence a current case, especially if they are similar in nature.
However, remember that this advice is general in nature. Specific advice should come from a lawyer who is familiar with all the details of your case.
You might want to get in touch with a public defender or a private attorney to discuss these issues. Legal Aid Center of Southern Nevada might be able to help. Their phone number is (*) *-*. You can also find more information on their website at http://www.lacsn.org/.
