My friend is soon to be released from Federal prison served * yrs. and when he was arrested he already had a case pending for possession and resisting arrest and went to his prelim then was arrested and went to the feds for drug charges. My question is could he ask for his state case to run concurrent with the federal time he's doing or time served? He had a Co defendent that has already done time for this case
Hello ****, it's a complex situation. Concurrent sentencing depends on many factors such as the nature of the crimes, the jurisdictions involved, and the judge's discretion. Also, the coordination between federal and state systems is crucial. Can you tell me in which state this is occurring?
California
In California, it's possible for sentences to run concurrently or consecutively. However, this is subject to:
- Judge's discretion
- Nature of the crimes
- Agreement between federal and state systems
It's advisable for your friend to consult with a defense attorney regarding this matter.
Ok can I ask one more thing? Can he be charged if the person who he was arrested with already pleaded guilty and served time?
Yes, he can still be charged. A co-defendant's guilty plea and served time doesn't automatically absolve others involved. Each person's case is evaluated individually based on their role, evidence, and circumstances. It's crucial to seek legal counsel.
