Common Law Marriage In Iowa

Full Conversation

My boyfriend and i have lived together for 12 years. We separated. I need to know if this isconsidered common law marriage. We have no accounts together. Never filled taxes together. The home we lived in is in my name. I do have him on my health insurance plan
Did you both present yourselves as a married couple to family, friends, and the community during your time living together?
No
In Iowa, common law marriage requires three elements: intent to be married, cohabitation, and public declaration of marriage. Since you didn't present as married, it's unlikely you have a common law marriage.
Ok that us what i neede to know. Dudnt want to go through divorce if didnt have too
I'm glad I could help clarify that for you. If you have any other questions about common law marriage or any other legal issues, feel free to ask.
Ok thank you.
Do you have any concerns about property division or any other legal matters related to your separation?

Iowa's common law marriage rules:
- Intent to be married
- Cohabitation
- Public declaration of marriage
No everything is in my name
Since all property is in your name, you generally have the right to control it. However, if disputes arise, you may need legal advice.
I dont think he will dispute it.
That's good to hear. If he does dispute, remember that Iowa is an equitable distribution state, meaning assets are divided fairly, not necessarily equally.
Ok thank you again
