Parental Rights And Retaliation
Summary
Your situation involves potential violations under Georgia Family Law, specifically O.C.G.A. § 19-9-3, regarding joint custody and parental rights. Consider consulting a family law attorney to address potential retaliation and interference with your custody rights.Full Conversation
hi, I have a joint legal custody order that gives my coparent sole medical decision making but allows for myself to take the child to the ER when need be and have access to all medical information and records. However, my coparent told staff at our son’s asthma appointment today to prohibit me from being able to be present for the appointment. What can I do ? Does this violate my legal rights
Hi ****! It sounds like a challenging situation. To better understand, could you let me know if your custody order specifies any limitations on being physically present at medical appointments? This will help determine if your rights were violated.
The custody order does not specify any limitations or denials on the right for myself to be present. It does state that the doctors do not need my permission for any decision making.
Hey ****! Based on your custody order, it seems you have the right to be present at medical appointments since there are no specified limitations. Here are some steps you could consider:
- Review the custody order carefully.
- Communicate with your coparent about the issue.
- Consult with a family law attorney for tailored advice.

The attorney for the asthma clinic has also kept me from attending the appointment. This attorney also testified at our hearing and has been retaliating towards me for reporting one of his doctors for prescribing a non fda approved medication use for our child. I also recently filed a complaint with the medical board against this doctor and so I think I am being further retaliated against by this attorney who is also an attorney for this doctor

the father and the asthma doctor were both allowing our son without try using an inhaler in an experimental way that had not been studied on children. I spoke out about it and then my access to the patient portal was taken away, I was blocked from receiving medical records temporarily, and now I am being blocked from just simply being present at my child’s appointment/
