False Accusations And Harassment

Full Conversation

Someone keeps making false anonymous accusations to DCF against my brother and his family. We have an idea of who it is but no proof. There has been * claims now against his family * have already been investigated and checked out. Without any evidence of who is making the calls, what other options are there?
Has your brother considered filing a harassment claim? This could potentially lead to a court order preventing further false reports.
The detective my brother spoke to may have said something about filing a "stalker protection order" excuse me if I worded that incorrectly. At some point when the investigations are done and everything checks out, what then? I believe this person may continue to make these claims.
What state is your brother located in? Different states have different rules regarding stalking protection orders.
Kansas
What is the nature of the false accusations being made against your brother's family?

In Kansas, stalking protection orders can be issued if a person feels threatened or harassed.
Neglect and SA
In Kansas, false accusations of neglect and SA can be considered harassment. Your brother can apply for a Protection from Stalking order. Contact the nearest court: Johnson County District Court, (*) *-*.
What do you think that will do?
Applying for a Protection from Stalking order can legally prevent the person from making further false accusations. If they continue, they may face legal consequences.
But if they are doing it anonymously, could they still get in trouble if he proceeds to file for protection?
Yes, even if the accusations are anonymous, legal action can be taken if the person is identified. The court can issue orders to trace the source of these false accusations.
Amazing, thank you so much!
You're welcome, ****! If you have any more questions or need further assistance, feel free to ask.
How likely is it that the court would issue a trace on a DCF call?
The likelihood depends on the severity of the case and the judge's discretion. However, courts can order traces in cases of harassment or false accusations.
Is that with or without a protection from stalking order?
A court can issue a trace both with and without a protection from stalking order, depending on the severity of the case and the judge's discretion.
Okay great!
