Cps in Mississippi isnt following protocol and now trying to remove my 1 month from my home
What specific protocol do you believe CPS is not following?
They coerced myself and my fiance into drug testing saying if we didnt they would remove the baby. There was never a safety plan offered or any assistance of any kind offered before deciding they wanted to take the baby.
Did you or your fiance test positive for any substances in the drug test?
Yes. But they knew i would. I was clean when i had him, but it took me a little while at first when i was pregnant to get clean. But when he was born they tested his poop and said i had a past use ... but again that was already known and they let me bring him home for an entire month
Did CPS provide any written documentation or reason for the removal of your child?
No
What steps have you taken since CPS made the decision to remove your child from your home?
I wasnt home when they came to get him, we travel for work and were out of town when they went by our apartment. We didnt know anything about it until this morning when we got home. I guess she scheduled court for yesterday but i didnt know anything that either

Did CPS attempt to contact your fiance or his boss about the court date?
Not my fiance. And she went to the shop and his boss told her we were out of town.
Did you or your fiance inform CPS about your travel plans and provide them with alternate contact details?
I didnt inform her of the travel plans but i was never told i was suppose to. And she has my fiances number. She never attempted us there.
Did you receive any written documentation from CPS regarding the removal of your child after you returned from your trip?
No. We just got home this morning. I have one text from her saying court is at * please there and that was yesterday. But she was at the apartment friday with officers to remove him.

I write her, call her, she has me blocked. Ive emailed and called her attorney. Have you considered filing a petition in court to compel her to provide the inventory list and bank statements?
How do i do that? And can i do that from another state. Thats the other thing. What is it called when you petition the court for part of your inheritance before probate is over
This is known as an "Advance Inheritance" or "Inheritance Advance". It's a way to access your inheritance funds before the probate process is completed. However, laws vary by state.
Whats the law in florida on inheritance advance
In Florida, an inheritance advance isn't typically allowed. The estate must go through probate and debts must be paid before any distribution. However, an executor may make a partial distribution if the estate's solvency is clear.
Is it up to the executor?
Yes, in Florida, it's generally up to the executor to decide whether to make a partial distribution before the completion of probate, provided the estate's solvency is clear.
Solvency meaning debts are paid
Yes, solvency refers to the estate's ability to cover all its debts. If an estate is solvent, it means it has enough assets to pay off its debts.
The homestead property doesnt count as an asset to pay off debt does it?
In Florida, the homestead property is generally protected from creditors and is not considered an asset to pay off estate debts, except in specific circumstances like unpaid property taxes or mortgage.
So to calculate the estates ability to pay off the debt i would total the debt and total the assets minues the homestead property
Yes, to calculate the estate's solvency, you would total the value of the assets (excluding the homestead property) and subtract the total debt.
How is the estate divided once everything is done
In Florida, once all debts and taxes are paid, the remaining estate is divided according to the will. If there's no will, Florida's intestacy laws apply, typically dividing assets among surviving spouse and children.
If there are two houses and two siblings do each get a house
It depends on the will's instructions. If there's no will, Florida's intestacy laws apply. Generally, assets are divided equally among siblings, but it doesn't necessarily mean each sibling gets a house.
Who decides that
The distribution of assets, in the absence of a will, is determined by the probate court following Florida's intestacy laws. It's not necessarily item-by-item but usually by total value.
Does any agency intercept inheritance
In Florida, inheritance can be intercepted or garnished by creditors if the deceased had outstanding debts. Also, the IRS can claim unpaid taxes from the estate.
What about debts myself. Like when child support takes your taxes
In Florida, child support arrears can be collected from your inheritance. The Department of Revenue Child Support Program can intercept federal and state income tax refunds to pay past-due child support.
How do i prevent child support from collecting
To prevent child support from collecting your inheritance, you would need to pay off any outstanding child support arrears. It's advisable to consult with a family law attorney for personalized advice.
