My husband of seven years accused me of harming him physically had me arrested and jailed. I went to stay with my daughter for the last two months. I want to go home now where I belong he says if I do because it’s his mother‘s house, I’ll be arrested if it was my house for the last five years how can I be rearrested? I’ve done nothing wrong
Hi ****! It sounds like a challenging situation. Here are a few things to consider regarding your legal rights in Tennessee:
- Check if there's a restraining order or protective order against you that prohibits you from returning to the home.
- Determine the legal ownership or rental agreement of the house to understand your rights to reside there.
- Consult with a lawyer to review the specifics of your arrest and any legal documents related to the property.
If you want to connect with a local lawyer who can better assist you, let me know.
There is no restraining order or protective order against me preventing me from returning to the home my husband is being bullheaded. There is no rental agreement. We were living with his mother because his father died. We had to help with the horses which are no longer there and should’ve already moved out of that place Into our own. I feel his mother and his brother are the issues and why he’s doing to me what he’s doing I think if I go home, we can go counseling and get it rectified and reconciled if I can convince him to move out from under his mommy’s roof
It seems you want to return to a home where there’s no legal restriction against you, but your husband is preventing you. Since there's no rental agreement and it's his mother's house, it may complicate your rights to reside there. Would you like help connecting with a local lawyer to discuss your options?
It’s not just that I want to go home, but he is going to try and say that I abandoned him and walked away which is untrue. He is the one who did this. I gave him time but now he’s gonna try and use it against me. It’s been two months, If I do not go home, he wants to file for abandonment. That’s what I heard through the grapevine which is why he’s trying to give me money tomorrow, After cutting me off financially abandoning me after emotionally abandoning me, before he ever called the police on me.
