My girlfriend lives in China and is trying to get her travel visa to be able to visit me here in the United States. She applied 3 years ago and is still waiting for them to process her application. I am wondering if there is any legal action she can take or I can take on her behalf to help.
Hi Chuck! I'm glad to help with this. For visa delays, you might consider:
- Contacting the U.S. Embassy or Consulate in China for updates.
- Consulting an immigration attorney for advice on legal actions, like filing a writ of mandamus to compel processing.
Has she tried contacting the embassy yet?
I am not certain if she has or not. She is a little nervous about doing so for of her government finding out she is in contact with the US Embassy.
It's understandable that she might be concerned. One option is to consult with an immigration attorney who can guide you both on how to proceed without causing issues. Is she facing any specific issues with her government that you are aware of?
No she has no criminal history at all not even traffic violations.
