Basically, what happened in the appeal is that once the process started the court did not set up my case correctly. They send it up, dominating the appeals process and derailing my appeal.. the court corrected the first case set up after I objected, but the new case set up after that was more problematic because it apparently involves settle legal arguments that could not be found in law books in the law library. That was a challenge for a self represented person who had never handled in a PO who could not afford an attorney, and who was at disabled senior.

The first case set up involved respondents you weren’t even listed on my notice of appeal and who had no interest in the property in the estate. However, in that case set up, my role was executor of the estate. Indicating that that will be my role during the appeal and that the law that state the order that I was appealing probate code section * a have been put into effect.. the new case set up with device by the chief clerk of the court . My role in it was no longer executor. It was just me as it as an individual and an appellant versus my brother labeled as respondent and opposing party and executor.. My brother was not on my side had never been a party to the matter and was not executor of the estate and opposed my removal as executor.. In response to my second request for extension of time, the court told me that I needed to file a motion to change the second case set up. It was shortly after that that I learned that there was little or no information on that in law books. I could not afford attorneys, but try to get whatever legal advice I could from attorneys…. I it took an incredible amount of time plus to get each little bit of information toward putting the motion together.. this in itself, led me to have to request multiple extensions of time to submit the first two documents that were due under the local rules, which were the civil appeal, mediation, statement, and civil case information statement.

I made my third extension of time request as a disability accommodation request. That was because the judge after I had said that I was still ill and didn’t know how long it would last had her second extension of time decision stated that no more extensions would be granted.

I was going to also file an extension of time request with that disability accommodation request because my disabilities were not the only things that factored into my need for more time. That the case set up still needed to be changed and that it was hard to put together a motion on it. Also factored into that need for example.. the court clerk, however, strongly discouraged me from filing a regular request of extension of time. He stated that my disability accommodation request would be enough and that I had not heard from the court and that they were waiting to see if there is opposition to. 10 days after that accommodation was granted a court clerk told me that it did mean that if I did not file those documents by April *, my case would be dismissed. In 10 days, I could not address the need to know by surprise designate the record on appeal, finish that difficult motion on the case, set up and the third thing that these new deadlines imposed file a petition for a writ of mandate with the California Supreme Court to review the denial of the accommodation. as for the petition to the Supreme Court due on May *, I didn’t even get all the steps to file the CCIS extension of time done on May * because of what pushing myself had done to my health and trying to meet the cluster of deadlines. In the meantime, I waited for decisions on the request that I had made on May * and May * for more time. In the meantime, even though I filled out a request for extension of time to designate the record on appeal., I got a default notice from the superior court for designating the record.. I shouldn’t have gotten that notice because I had requested extension of time. When I called the superior court about that the superior court admitted to me that the appellate court had informed them that I had requested extension of time.. rather than vacating, the order to declare me in default, the superior court, kept it waiting for a response from the appeals court. That I suppose would be a way of depriving me of the default care period for design designation of the record on appeal.

At that time, I was concerned about a hearing coming up in the superior court on July *. It was a hearing that the probate court had set in March. In that hearing, the judge who had removed me as executor, was trying to talk my brother into becoming the executor of the estate, even though my brother did not want to be the executor.. I attended the hearing, even though I was not required to appear and objected to that lead that my powers, as executor should’ve been restored once I filed my notice of appeal and that there were no allegations of my having caused waste or harm to the estate that would justify having it otherwise during the appeal.
