Hi, Would an Appeals Court accept a Notice to Appeal for a lower court procedural issue ?
Hi there! Generally, an appellate court may accept a notice to appeal if the procedural issue in the lower court affected the outcome of the case. Yes. The procedural issue concerned my capacity to act upon the Court's "Notice and Response" procedural Rule. In my lower court case, I filed two Responses to Defense's two Motions to Dismiss. One Response to the first Motion to Dismiss and the other Response was filed after the Court dismissed my case without prejudice. That is evidence that I did follow the Procedural Rules. My Notice of Appeal was not based upon following the Notice and Response Procedural Rule. Rather, My Notice to Appeal was based upon my substantive claims that the lower court breached the * core requirements of my Due Process Rights under the 14th Amendment. Thus, my Appeal, as is always the case, was to contest the lower court's decision to dismiss my case.

Thanks your comment. It is critical one of several reasons the Appeal Court's * judge panel bsed their dismissal of my case. This clarification between procedural rule and Substantive claims is critical for my Motion for Fraud Upon the Court because it proves the court's intent was to misrepresent the facts of my case as presented in my Opening Brief Procedural Rule and then bse their Dismissal on the misinterpretation. I also believe that it would serve to strengthen my claims of Fraud upon the Court, if I stated that the Appeal Court would NOT have accepted my case for an alleged breach of a Procedural Rule. A Rule, in fact, that I properly followed.

Not quite yet. I have several more fraudulent claims to research. Fraudulent claims the judges made in order to justify their dismissal of my case. The other fraudulent reasons are much worse than this misinterpretation !

I certainly will seek legal guidance when I have finished the drafts of my Motion for Fraud, Motion to Vacate Judgment andMotion to Recuse, etc. After my drafts are done, I will definitely need legal guidance ! It's just that my drafts may take a while to complete. I leave nothing to chance ! As I stated in my Opening Brief, "Why would I waste my time, energy, and peace of mind if the probability of prevailing with my case was NEGLIGIBLE !
