Child Custody Legal Guidance

i am located in NYC, Brooklyn, Kings County, to be exact, and my boyfriend is currently trying to obtain full custody of his child. There is no custody agreement in place, and paternity has been established via an AOP, as both parents admitted to him being the biological father. His son is 1 year old as of now, and he has not been able to make contact with his son since June 6th of this year, except for seeing him recently outside because he just so happened to catch them outside, and the mom allowed it for the moment. (im not done ill simply say done when im ready for you to answer).

Other than those * times, he has not seen his son because she sent him multiple voice notes on June 7th, I believe, saying he called ACS on her and if he wants to see their child, he better "take her to court." She also stated in those messages that when she sees his new girlfriend (me), she will be "fucking her up" as well because she believes I made him call ACS on her. She has made promises twice since he hasn't seen his child to allow him to visit, but both times she neglected to allow him the time with his son. In fact, she has him blocked on everything, so he isn't able to be updated on his son or even contact her regarding his son. he has to rely on possibly seeing her outside or someone in the neighborhood telling him they see his son outside with his mother.

Her older child, who is about * or *, has also harassed my boyfriend via social media, sending messages threatening him. Also, the mom has multiple ACS cases that date back to before their son was even born. the mother has had about * different ACS cases since the child was born and before he even turned *. his father missed him walking for the first time as well as his birthday, which was August 13th. in fact, the messages he got from her daughter were on the day of his son's birthday, further inflicting emotional pain on him due to not being able to see his child for his first birthday. One case since their child was born was a fire on Valentine's Day this year that jeopardized he lives of all her children.

She was not in the house when the fire happened, as she was out with her boyfriend at the time, enjoying Valentine's Day. Her claim was that her older daughter, who was about * or *, was in the home with her boyfriend, and they were supposed to be supervising the children, but apparently, they couldn't do that correctly because it resulted in a house fire where they lost everything and almost their lives and the life of my boyfriend's infant at the time. My boyfriend and I rushed to the scene of the fire, as he received a call from someone in the neighborhood who informed him about the fire and his son. The person who called him took his child from the mother's other children until we got there. When we arrived, and we finally saw her arrive after, I held the baby in my arms in the backseat of my car, and my boyfriend was outside speaking with the child's mom.

I recall him asking her where she was when the fire happened, and she responded saying "I was out enjoying my Valentine's Day, wasn't you?" as she held her plastic cup topped with a covering and a straw that I am sure was filled with more alcohol, as she was already drunk upon seeing her. Her boyfriend at the time stood off to the side watching the scene, as I am too. The next ACS case happened when there was a call and my boyfriend got a call asking if he was prepared to come get his son due to the home not having any food or formula for the children there, and he said yes. As soon as he was in route, the ACS worker texted and said it was ok because they were able to assist the mom with some groceries so the child could remain in her care. Keep in mind this entire time, the mom has a preventative worker, so isn't she supposed to prevent visits from ACS and them helping in this way?

Also, when she and my boyfriend were a couple, i guess she had him on her children's blue cards at school as an emergency contact, so he still receives texts and voicemails form her kids' schools regarding their attendance (lack thereof) in her kids cases. Also she has * other children outside of my boyfriend's child. She lives in a *-bedroom apartment with * children total. one room belongs to her older daughter and her older daughters live in boyfriend. the next room belongs to the mom. the other two rooms, the remaining children (*) must have to share the other two rooms im assuming because there isn't any space really. Also, she has a brother who is a fugitive in Delaware and he has been running since * I believe. He was on an ankle monitor prior to running, but he cut it off and has been living here in Brooklyn but still homeless, as he was in Delaware as well. He is wanted for sexual conduct with a minor under the age is *.

In fact, the child was not any child, but I heard it is HIS CHILD he did this to, and I heard there was another person involved as well. He is listed on the sex offender registry in Delaware although he has not registered here in nyc for obvious reasons. He is a tier * offender although it doesnt say that he is a repeat offender, but he is tier * (which is the highest level). He sometimes pops up randomly to the child's mom's home an she doesn't refuse him when he does come. Also, there was a time when my boyfriend was allowed to see his son, he spent the night over our house and when we got him we changed his diaper. upon changing him, i discovered a rash of some sort on his genitals and buttocks. I mentioned it to my boyfriend and he called her showing her and she stated to put A&D ointment on it . We did as instructed, but the next morning when i went to go chnage the baby again, it was worse.

We took pictures of it before and the next day when we seen it got worst. we took him to the urgent care and he was diagnoses with a severe diaper rash that turned into a fungus. He was given some medicated ointment for it that helps with thrush in the mouth and fugus. He also hd thrush before when he came over to our home but we have no medical documentation of that, as she took him to the hospital for that specific issue. In our home, we have an extra bedroom that is considered the child's room, he has a toddelr bed, clothing, food, toys, developmental things, and i have a license in resource parenting in the state of NJ (thats where we live but the child and case is in NYC Brooklyn).

I have no children, so he would have his own space and the mother doesnt work and hasnt for years. she gets government assistance for herself and all her children. my boyfriend, the father, doesnt have a job either but in the time he has been away from his son he an show history of job searching, interviews, and he could possibly have a interview and be working before his september 22nd court date, as his interview is september 10th. He also obtained his high school diploma and not GED at 36 years old from Penn Foster online school and an electrician certification as well. we live together so has a place for the child to live as well and i maintain and provide financially until he is able to.
