My son just went through divorce and custody cas last week and he lost custody of his son. As far as we know the new order has not been signed and there is an old order in place. But my question now is that she is only giving my son his every other weekend and she informed him today that she is going to be out of town and the child will be left with her ex-step dad and his wife while she is gone. My son has asked for this time since him being without him for long perids of time is hard on him . Shouldn't she offer that time to the father (my son) and not her ex family members?
Hello ****,
In Kansas, the law generally encourages both parents to play an active role in their child's life. However, the exact rules can vary based on the specifics of the court order. To clarify, was any "right of first refusal" included in your son's custody agreement? This rule sometimes requires a parent to offer the other parent the opportunity to care for the child before arranging alternative care.
This is an Arkansas case and we have yet to see the new order.
Hello ****, as this is an Arkansas case, the specifics might differ. Generally, the "Right of First Refusal" could apply if it's in the order. However, without the new order, it's hard to say definitively. Your son may want to consult a local attorney for specific advice.
he had an attorney but because of that attorney not getting discovery in on time and not asking for an extension we were not able to submit any witnesses or evidence other than myself that has been part of the process from the start. So we are not sure how to get the information on what is in the order
I'm sorry to hear about your son's situation. For the final order, he can request a copy from the court clerk where the case was heard. If your son feels his attorney didn't represent him well, he might consider filing a complaint with the Arkansas Bar Association.
We are doing that and we are also going to seek representation to try and go back and change the custody with a new lawyer and all of our evidence. But with his current lawyer not corresponding in good time we don't know when any of this will be. There was an AAL could we reach out to him to see what the final order is?
Yes, reaching out to the Attorney Ad Litem (AAL) may help in obtaining the final order. It's crucial to keep all communication professional and respectful. Consider hiring a new attorney promptly to help navigate through the process.
