In my divorce case the court clerk failed to file * of my documents and instead she filed them in the petitioner's name. I did not find out until almost 2 years after the divorce was over and since discovery of fraud someone in the clerk's office has changed the electronic data on a case and reversed back the names on half of the documents that were never filed in my name and now they appear in the case file as though they were filed on the date I submitted them to the clerk's office. Can I ask for in this trial
I'm not a lawyer, but I can try to help. Have you spoken to an attorney about this issue?
No I have not yet I have tried but I don't have the money
I understand that you haven't been able to speak to an attorney due to financial constraints. It's important to have legal representation in a complex case like yours. Have you considered reaching out to any legal aid organizations in your area? They may be able to provide free or low-cost legal assistance.
I have tried but because this is not just a simple custody or restraining order question no one wants to deal with it
I understand that this is a complex case. Have you tried reaching out to any pro bono organizations in your area? They may be able to assist you with your specific legal issue.
I'm just asking for a simple question to be answered
I apologize for any confusion. Please go ahead and ask your question, and I'll do my best to provide you with a simple answer.
Can I ask for a Ms trial based on the fact that * of my documents were not filed by the time the trial occurred my twelve documents were filed in the other party's name
Have you already filed a motion to correct the record regarding the misfiling of your documents?
No I have not and as a matter of fact six of the documents have already been corrected without any order or request or authorization even according to the clerk's office
Have you spoken to the court clerk about the misfiling of your documents?
Yes and they do not know why this happened except I can tell you that not only were there's more things that had happened not just the * documents admitted from the case there are other inappropriate actions occurring as a result of a clerk targeting any document that I filed as a proper litigant I should start over my explanation.
I'm sorry to hear about the issues you're facing with the court clerk. It's important to address these concerns. Have you considered filing a complaint with the court administration regarding the inappropriate actions of the clerk?
At first I did have an attorney and the first six documents filed in my case or filed by my attorney on my behalf one of the last documents filed was substitution of attorney because I had to fire my lawyer. From that date forward all documents I filed were filed in the other party's name and even the six prior documents filed by my attorney were changed from these filed by me to be filed by the other party. The documents include my fee waiver and tro and other domestic violence documents all of which clearly identify as my documents were not filed as my documents and I believe in change the opinion of the Court as my documents were not present in the case in electronic format
I'm not a lawyer, but it seems like there may have been some issues with the filing of your documents. It may be helpful to consult with an attorney to discuss your options.
Okay let me rephrase my question. In the divorce case if a party's documents are not filed * documents almost half of all the documents filed by that person in the case can a missile be requested
I'm not a lawyer, but in a divorce case, if your documents were not filed and were instead filed under the other party's name, you may be able to request a mistrial. It's best to consult with an attorney to discuss your specific situation.

I'm not a lawyer, but it seems like your ex may have lied on the tax returns. It's important to consult with an attorney to discuss your options and determine the best course of action.
