Can you provide more details about the incidents and if you've reported them to your employer? In general, these actions are illegal under federal and state laws.
Yes, ive reported it to my store manager, who has done nothing about any of the issues im having with my direct manager.
Have you documented these incidents and your report to the store manager? It's crucial to have evidence in such cases.
Yes
What state are you located in? This will help me provide you with the specific laws and resources in your area.

What specific actions did your direct manager take that you believe constitute harassment, discrimination, and retaliation?
It started with her making belittling/embarassing comments in front of my peers & associates below me. When id told her it bothered me & asked her to stop, she said she was going to "do it * times worse" because she needed to "toughen me up". She told me she expects me to take * minute lunches instead of the * hour that associates are entitled to and even though i have explained on multiple occasions that i cannot take * minute lunches due to medications i go home to take, she still says it is part of her "expectations" to do so and that i need to "provide a doctor note" for proof that i take medications on my lunch at home. I have plenty more examples if needed.
Have you provided the doctor's note as requested by your manager?

In Nevada, employers must provide a meal break of at least * minutes for every * hours worked.
At my job, if you work * or more hours, you are allowed to have a * hour lunch and * paid * minute breaks. No, i have not and will not provide her a doctor note because it is not okay for me to have to prove that i take medications for my mental disabilities.
Have you considered filing a complaint with the Nevada Equal Rights Commission or the U.S. Equal Employment Opportunity Commission?

Thank you very much. I am also a walmart employee if that information is helpful.
What specific discriminatory actions have you experienced at Walmart? Walmart has a strict policy against discrimination and harassment.
Discrimination in regards to the way i process things due to my mental disabilities, to which i have been very open and straight forward with management about since day *. Example: if i am being given multiple tasks all throughout the day at random while in the middle of something, ( like counting back money for a customer ), i am not going to be able to focus on what im being told without messing up what im currently doing. I always either write down notes, type notes into my phone, or request that they message me the directions so I can review it when im finished handling my current obligation. My direct manager no longer does this. Whenever i try to ask my direct manager a question on how to do something or how to handle a specific work-related situation, or if i ask her to repeat herself because i didnt hear her, she always makes either a snobby comment like, "oh so you just dont want to listen", or looks at me like im annoying her or says "mhmm yeah mhmm" like im going to slow for her. She treats me like a child. She will give me soverbally then later on, she
Have you reported these specific incidents to Walmart's Human Resources department? Walmart has a policy against discrimination and harassment, and they should be able to assist you.
Yes
What was the response from Walmart's Human Resources department when you reported these incidents?
Well, i went to my HR manager and told her i wanted to contact ethics. She told me to wait for my store manager to get back from vacation to request an open door with him first so that way im following process. 3 days later, my store manager had returned and i asked him if i could have an open door as soon as possible with him. He didnt get with me until the next day. The next day, i was able to speak with him. Everything we'd discussed, he continuously had an excuse for the things my direct manager had said to me and made it "justifiable" by telling me i could have done this or that. He then told me hed look into my write ups that my direct manager had given me and would follow up with me on it. It's been * weeks and i haven't heard * word from store manager about it.
Have you considered escalating your complaint to Walmart's Global Ethics Helpline?
I'm afraid to.
Why are you afraid to escalate your complaint to Walmart's Global Ethics Helpline?
Because it goes right back to my store manager and i feel that i don't have any proof to help my case. I have recordings of conversations with direct manager but it is against walmart policy to record.
