As per the Americans with Disabilities Act (ADA), an employer can request documentation that an employee's service animal is required due to a disability. However, the employer cannot ask about the nature or extent of the person's disability. If you feel your rights are being violated, you may want to consult with a local employment attorney.
After a year
Your employer asking for medical documentation after a year could potentially be a violation of ADA rules. However, without further context, it's hard to provide a concrete answer. You should definitely consult with a local employment attorney.
In February he saked what shae was for. I let him know and he never emailed back. I came in this morning to an email saying i had to report to HR for this. Then they demanded my medical records for her to continue to be here after a year of her being here.
Based on ADA:
- Employer can't ask about the nature of your disability.
- They can ask for documentation proving need for service animal.
- If you feel violated, consider a complaint with Equal Employment Opportunity Commission (EEOC) or consult an attorney.
