My prior company sold our division to another company. My coworkers and I are in the state or Montana, California, Nebraska, and Colorado. We are no longer employees of the previous company and have accrued PTO amounts that should be paid out from the previous company. Colorado/Nebraska/California Vacation Payout Laws: Colorado/Nebraska/California/Montana law requires employers to pay out all earned and accrued vacation time upon separation of employment - this is a very specific legal requirement. The state prohibits "use-it-or-lose-it" policies for accrued vacation time.
