Louisiana Termination Documentation Requirements

Summary

In Louisiana, employers can terminate employees without requiring them to sign documents. However, they must submit the LWC-77 form for unemployment insurance purposes. If an employer fails to submit this form, it may be a violation. Additionally, employers must comply with ADA requirements, including engaging in an interactive process for accommodations. If an ADA accommodation request is dismissed, it may be grounds for a discrimination claim. Concerns about workplace safety and ADA violations should be addressed with legal assistance or by contacting relevant authorities.

But isn't the company violating state law by refusing to give you the mandatory LWC-* notice upon termination?

In Louisiana, employers are required to reasonably accommodate employees with disabilities under the ADA. If your employer dismissed your ADA accommodation request, you might have grounds for a discrimination claim. Consider the following:
- Employers must engage in an interactive process about accommodations.
- Discrimination claims can be filed with the EEOC.
Would you like more information on filing a complaint or assistance in this matter?

I suffer with alcohol disorder syndrome and depression and I have been accepted by Louisiana rehabilitation services to work with them as well. A child in my class told another student that he'd shot me outside of class if he saw me. He even made gun fingers. He also touched a girl students hair then touched my hair, walked out of class cursed and I filed the ADA as it interfered with my recovery and my feelings of safety. Thing is.... I didn't tell them about the gun until I filled the ADA which waas a bout a week later an dhe had been doing other things. The admin told me that since it was a long time ago they couldn't do anything and they didn't think the student woudl do anything anyways. then I was demoted then fired.
