I do not have a candidate's driving record because I need a driver's license to run the report
In Massachusetts, if you cannot obtain the candidate's driving record without their license, you can request the candidate to provide a certified copy of their driving record from the Massachusetts RMV. Alternatively, you may verify their driving status by asking for consent to use their personal information to retrieve the record directly.

I used a company to pull records but they only allow for the license number and state to be indicated.
In Massachusetts, if the company you use requires a license number and state, you may:
- Request the candidate to provide their driver's license number.
- Ask the candidate to obtain and provide a certified copy of their driving history from the Massachusetts RMV.

Why can't I simply say you need to produce a valid driver's license as part of our onboarding process.
In Massachusetts, you can require a valid driver's license as part of onboarding if the job requires driving or a license is essential. However, the request must be job-relevant and comply with anti-discrimination laws. Would you like information on ensuring compliance with employment regulations for such requests?
Candidates can be a driver - no but because the CORI returned an open case I asked about the circumstances around the case. Then from the dates and information given there was an inconsistancy that she may have been driving illegally which is a serious lapse of judgement. Having good judgement is critical when providing one on one care with the elderly in their homes.
In Massachusetts, you can rescind a job offer based on concerns about judgment and qualifications, but you must ensure compliance with CORI regulations and anti-discrimination laws. Verify that your employment decision is based on job relevance and documented evidence. Would you like guidance on ensuring CORI compliance in employment decisions?
yes
In Massachusetts, to ensure compliance with CORI regulations when making employment decisions, you should:
- Provide the candidate with a copy of their CORI report before taking adverse action.
- Allow them an opportunity to dispute or explain the information.
- Document the job relevance of the decision.

Ok but to be clear, the incident in the CORI by itself would not lead us to rescind the offer. It is when questioned about the circumstances around the open case which we uncovered that she was most likely driving without a valid driver's license.
Under Massachusetts law, you can rescind an offer if inconsistencies raise valid concerns about a candidate's judgment, provided your decision aligns with CORI regulations and anti-discrimination laws. Ensure you:
- Provide the CORI report to the candidate.
- Allow them to explain or dispute the information.
- Document how the decision is job-relevant.

What if I only want to give * hours
In Massachusetts, you can shorten the timeframe for a candidate to respond, such as giving * hours, as long as it is reasonable and provides them with an opportunity to explain or dispute the information. Update the notice to reflect the *-hour timeframe instead of * business days. Would you like assistance revising the template?
I think the only way to dispute the situation would be to present a valid driver's license. She could not produce it in our second meeting even after going to her car for * min.
In Massachusetts, you can require the candidate to present a valid driver’s license as part of addressing the concerns, provided it’s job-relevant and aligns with CORI regulations. Ensure your decision is based on documented evidence and allows the candidate to respond. Would you like help revising the notice to include this request?
I would like that we stop saying the CORI is why we are rescinding the offer. We are rescinding the offer because she had a traffic incident last yeas which she disclosed. When asked if she had a valid driver's license she said yes and point to her MA state id card. I explained that an id card does not give permission to drive and asked again if she had been driving on her id card or a valid driver's license. She said she has a valid driver's license. Noteworthy is that she drove to the onboarding process and did not have a driver's license on her.
In Massachusetts, if the rescission is not based on the CORI report but rather on disclosed behavior or inconsistencies, ensure your communication reflects this. Emphasize the job-relevant concerns (e.g., judgment, trustworthiness) and avoid referencing CORI if it’s not the primary factor.
