Filing Auto Insurance Claim
Summary
Filing an auto insurance claim in Missouri involves reporting the accident, documenting the incident, filing the claim, and having an adjuster evaluate the damage. After receiving a settlement offer, you can sign the agreement and proceed with repairs. If a claim is incorrectly reported to CLUE, request documentation from your insurer and dispute with LexisNexis. Consider filing a complaint with the Missouri Department of Insurance if necessary. Legal action may be an option, and consulting a lawyer specializing in insurance disputes can provide guidance.Full Conversation
my car was hit by a tow truck Jan *,* and no one was in the car or driving, it was parked in front of my house. I made a call to my insurance to let them know (because I thought that was the law) that my jeep was hit by someone and that they were going to pay to have my car fixed. I was still waiting for them to get me a rental car so I could go to work .After a day of not getting a rental I called my adjuster, gave her the insurance info on the tow truck and asked her to call their adjuster for me to get me a rental. I figured since they were both adjusters ,mine would be able to move them along faster than I could, obviously. But I eventually got a rental car from that adjuster from Shelter ins, later that evening.
It sounds like you've already taken significant steps. Here's a summary of what to do next in your situation:
*. Follow Up with Your Adjuster: Ensure all necessary documents and details are submitted.
*. Wait for Damage Assessment: The adjuster will evaluate the damage to your vehicle.
*. Review the Settlement Offer: Once assessed, you'll receive a settlement offer. Review it carefully.
*. Sign the Agreement: If the offer is satisfactory, sign the settlement agreement.
*. Repair Your Vehicle: Get your car repaired and ensure the insurance covers the costs.
Is there any specific part of the process you're unsure about or need further assistance with?

My insurance adjuster reported to C L U E that I filed a claim for a rental car. I have disputed this many times with lexus nexusand i asked them for proof.Where did I sign a claim form for anything,I even asked the adjuster at my insurance company for proof and she has so far refused to send me a copy of such claim.I did not file a claim .I know that would raise my own insurance ,So is it supposed to be a claim reported to clue when I filed a claim against the person who crashed into my parked car? I did not file a claim on my own insurance and I thought that was what you report to clue. CLAIM history. But when there is no claim filed at all and they just report $*.* is that fair or legal?
It sounds like a frustrating situation. Here are some steps you might consider:
- Request Documentation: Send a formal written request to your insurance company for all documents related to the claim.
- Dispute with CLUE: Continue disputing the report with LexisNexis, providing any proof you have.
- File a Complaint: Consider filing a complaint with the Missouri Department of Insurance.

To dispute the claim, you can request the following from your insurance company:
- Claim Form: Official documentation of the claim you supposedly filed.
- Adjuster Notes: Notes from the adjuster regarding the claim.
- CLUE Report: A copy of what was reported to CLUE.
Have you already sent a formal written request for these documents to your insurance company?

yes, and I disputed with clue and lexux nexus .So I assume the adjuster does not have to show proof of me filing a clIM. i GOT AA RENTAL and my car repaired that show the other insurance paid for *% of the repairts so common sense would show i would not need to file a clIM OMN MY INSURANCE,.sHE SAID I FILED A CLim for rental and i already hD AN INSURANCE CLAIM with the at fault party

lawyers only sue if there are injuries

That's not entirely accurate. Lawyers can handle various types of disputes, including those involving insurance claims, even if no injuries are involved. Insurance disputes, breach of contract, and bad faith claims are common areas lawyers work on. If you change your mind and need legal help, feel free to ask!

It sounds like you've been through a lot. While small claims court is an option, lawyers can still help with insurance disputes even without injuries. Would you like guidance on how to proceed with small claims court in Missouri?
