problem getting the the title from the owner of the house that bought the house is paying off last year of the house
Hello ****, it seems you're having trouble obtaining the title for a house you've bought. Can you tell me your location? Laws regarding property transactions can vary by location.
I live in Tucumcari,NM.
Hello ****, in New Mexico:
- The property title is usually transferred via a deed.
- A title search is necessary to ensure the seller has the right to sell.
- If there's a dispute, you may need to file a quiet title lawsuit.
If you're unable to resolve this, consider contacting a local real estate attorney.
The thing is that I already paid the deed of the title and the notary fee to the seller that I bought the house from owner and she refused to give us the deed and the notary to transfer the house to us and I couldn’t understand her situation is?
In New Mexico, if the seller refuses to transfer the deed after payment, you may:
- Demand for a deed in writing
- If refused, you can sue for "Specific Performance" to enforce the terms of the contract.
Consider consulting a real estate attorney for further guidance.
