I was suppose to go to closing on my town home in March. I put *,* down and was approved. I was texted by the realtor handling me who works for a big builder Lennar homes that if I agree to close by the end of February a month earlier. I would get free HOA for a year. I agreed and they moved it up. NOW a week before closing the realtor texted me again and said sorry that free HOA promotion ended on February 2nd and you signed the 9th. And she said there is nothing she can do about it. Is that not a breach of contract I have the text message and she even says in her response that she should of never told me that.
Hi ****! That sounds frustrating. It seems like it could be a breach of contract if you have written evidence of the offer and your acceptance. Here are some points to consider:
- Review your contract for any clauses related to promotional offers.
- Gather all written communications, including text messages and emails.
- Consider consulting with a real estate attorney for a detailed assessment.
Would you like help connecting with a local lawyer to discuss this further?
not yet thank you
Alright, ****. Do you have a copy of the original contract you signed and any documents or texts confirming the promotional offer? It would be helpful to review them for specific terms and conditions.
