hi i live in corning california. i am experiencing serious dental issues amd wanted to see if my issue is worthy of taking legal action againt either the dentist or the individual who was paying for it
Hello ****,
To better assist you, could you please give more details about the dental issues? For example, was there a malpractice by the dentist or was there a breach of contract by the individual who was supposed to pay for it?
well when i was employed by a man named bernard flynn i was experiencing dental problems from an accident about 4 years prior. so bernard offered to pay to have my teeth fixed. so i went to a dentist that i was referred to by a family member to receive a quote. the dentist stated that it would cost roughly $*,* . so i
Hello ****, could you clarify whether Bernard Flynn agreed to pay for your dental surgery and if so, did he breach this agreement? Additionally, do you believe the dentist acted negligently?
so i showed bernard the papers that broke down exactly what everything would cost, totalling about $*,* and he agreed to pay for. so i started going to my dental appointments. after i think the 4th appointment i realized that rather than fixing a tooth or even * or * teeth at one time until all teeth were fixed he had began working on all of my teeth. so after about the 4th appointment i still hadnt had one tooth fixed only a good portion of them started and bernard was beginning to question if it was worthing it to him because he was seeing any results and he was paying cash out of pocket for all of this so he decided i should "take a break" from attending my dental appointments. but i never did begin attending my appointments and my employment there was soon terminated
Based on your situation, your potential legal actions could be:
- A breach of contract claim against Bernard for agreeing to pay and then failing to do so.
- A malpractice claim against the dentist if you believe his treatment was negligent.
The success of these claims may depend on the specifics of California law.
ok. where do i go from here
Hello ****,
- Collect all relevant documents (agreement with Bernard, dental records, etc.)
- Consult with a local attorney to evaluate your case.
- File a complaint with the California Dental Board if you suspect malpractice.
- If viable, proceed with a lawsuit.
theres was no written agreement with bernard
Hello ****,
In California, oral agreements can still be legally binding. However, they are more challenging to prove. Having any form of evidence, like text/email conversations or witness testimonies, might help. It's advisable to consult with a local attorney.
