Hospital Bill Liability Litigation
Full Conversation
What does it mean when my itemized hospital from the wreck says liability litigation?
Hi ****, "liability litigation" usually refers to legal proceedings to determine who is legally responsible for the accident. It's often used in personal injury or property damage cases. Can you tell me where the accident occurred, so I can give you more precise information?
My 16 year old was in a wreck */*/*, her best friend was driving and was at fault. My daughter suffered tge most injuries. Her ER visit that night is $*,*.*.
Hi ****, I'm sorry to hear about your daughter's accident. Based on the information you've provided, you may want to consider pursuing a personal injury claim against the at-fault driver. However, specific laws can vary. May I ask in which state the accident took place?
Progressive is their insurance and I filed a claim but so far they have not even attempted to make a settlement offer. They keep trying to get me to sign a medical records release form, when I have already given them the dr notes and findings, the email reports, the ent notes where she was referred.
I'm sorry to hear about your struggle with the insurance company. You may not want to sign the medical release form as it could give them access to all your medical history. However, the laws vary by state. Could you please tell me in which state you filed the claim?
SC
Thank you for sharing, ****. In South Carolina:
- You have 3 years to file a personal injury claim.
- You can seek damages from the at-fault party's insurer.
- Insurers may request medical records to evaluate claims but you can limit what they access.
Consider consulting a local attorney for personalized advice.

I have and was told that they shouldn’t be asking for anything else cause I have given them what they have already asked for and more. Not to mention ther friend and the lady she hit have already gotten their settlement and cars
It seems you're dealing with a complex situation, ****. In South Carolina, you have the right to:
- Refuse unnecessary requests for information.
- Negotiate with the insurance company.
- Pursue a lawsuit if the settlement offer is inadequate.
Remember to consult with a lawyer before taking any steps.
