Dealership Oil Change Dispute

Summary

A dealerships improper oil change led to engine damage. Despite contacting them, they refused compensation and mechanic details. Documenting the issue, including their advice to top up oil, strengthens your case. Filing a complaint with the Alberta Motor Vehicle Industry Council (AMVIC) is recommended. If unresolved, consider small claims court. The dealerships refusal to provide mechanic details and failure to torque the oil filter as per specifications can support your case.

Thanks for providing the details, Caleb. It seems like you have a strong case. Here are some steps you can consider:
- Send a formal complaint letter to the dealership detailing the issue and your demands.
- If no resolution, consider filing a complaint with the Alberta Motor Vehicle Industry Council (AMVIC).

- Visit the AMVIC website at www.amvic.org.
- Click on "Consumers" and then "File a Complaint."

Would you like any further assistance on this matter?
would i have to take them to court for the damages
Case Rating: *
You might not necessarily have to take them to court if the AMVIC complaint resolves the issue. However, if the dealership still refuses to compensate, you may consider small claims court.
Did you have any other questions or need more information on small claims court procedures?
i did have to top up my cars oil once in november and when i called they just told me to fill it up they never told me to bring it into their shop does that affect my case at all
Case Rating: *
Topping up the oil in November could complicate your case, as the dealership might argue it was your responsibility to bring the car in for inspection. However, if the initial oil change was improperly done, it still holds them accountable.

It sounds like you have a solid case due to the dealership's failure to properly perform the oil change, which directly led to engine damage. However, the fact that you topped up the oil without taking the car back to the dealership might be used against you.
If you need further assistance, feel free to ask!
could it still be used against me even though i called them and asked why and they told me just to fill it up
Case Rating: *
Yes, their instruction to just fill up the oil rather than inspecting the vehicle could indeed be used in your favor. It shows that you sought their advice and followed their guidance. Documenting that conversation can strengthen your case.
Would you need more information on documenting this or any other legal assistance?
does it also help that the dealership is refusing to provide me the name and mechanics # that worked on my car
Case Rating: *
Yes, the dealership's refusal to provide the name and number of the mechanic can help your case by showing a lack of transparency and cooperation on their part. This can be viewed negatively by a court or regulatory body. Do you need any more assistance with this?
how can i make sure to win this case
Case Rating: *
To strengthen your case:
- Gather all documentation, including photos, mechanic reports, and any communication with the dealership.
- Highlight the dealership's refusal to provide the mechanic's details.
- Emphasize that you followed their instructions to top up the oil.
Would you need any more specific strategies or tips?
does it being done in august of last year affect that it blew up 6 months later. and after 4000km driven
Case Rating: *
The time lapse and distance driven could be argued by the dealership as factors in the damage. However, if you can clearly show the damage was due to the initial improper oil change, you still have a strong case.
Would you like more specific strategies or tips to strengthen your case?
by porsches oil change specs it shows the oil filter must be torqued to a specific ft lbs, and on their repair/ oil change slip they gave me after the oil change it shows that they only torqued the oil plug not the filter is this in my favor
