Fcra Data Leak Liability
Summary
The Fair Credit Reporting Act (FCRA) under 15 U.S.C. § 1681n addresses civil liability for willful noncompliance, allowing individuals to sue for damages. In Georgia, the statute of limitations for FCRA-related data leaks is generally two years from discovery, not exceeding five years from the violation. If AT&T leaked your data, consider contacting them, filing a complaint with the FTC, and consulting a lawyer. Settlement guidelines vary, and prearrangements by lawyers without filing may affect your legal strategy. If you settled for $30,000 and have concerns about your lawyers actions, review the fee agreement and consider consulting another lawyer or filing a complaint with the State Bar of Georgia.Full Conversation

unbeknownst to me my lawyer had a prearrangement to settle my case they never even filed it so does that mean that I am not protected under 15usc 1681n and can be charged for lawyer fees

In your situation, the Fair Credit Reporting Act (FCRA) under * U.S.C. § 1681n could still apply to hold responsible parties accountable for willful noncompliance, even if your lawyer had a prearrangement to settle the case. You might still be able to recover attorney fees and costs. However, if your lawyer didn't file the case, it might affect your legal strategy. Consulting another lawyer might be a good idea. Let me know if you need more guidance!

how will it affect my legal strategy and I tried to arbitrate it but the bar never responded I'm guessing because it wasn't a filled case so is there a loophole for lawyers ? or no?
Case Rating: *
If your lawyer had a prearrangement to settle without filing, it might affect your leverage in negotiations. Typically, there aren't loopholes for lawyers to bypass the need to file a case if arbitration or court action is required. Consulting another lawyer may provide clarity and options.

im wanting to know if that is in compliance with * usc1681n and my civil rights and the lawyer serving as my fiduciary and not having any filing or court costs and if a prearrangement was made the costs shouldn't be that high . They didn't mean for me to find out they never filed the case but I called around and found out that there was none filed .

Your situation raises valid concerns under * U.S.C. § 1681n, which addresses willful noncompliance in FCRA cases. If your lawyer didn't file the case or settled without your knowledge, it may affect fiduciary duty. You might consider exploring whether your lawyer acted inappropriately or breached their fiduciary duty. Have you reviewed the fee agreement with your lawyer?

we did but at the end of the case they switched names and tried to get me to sign a second agreement that I never did sign I didst sign it because I had found out that they didn't file the case and then they tried to add a second violation in and I objected and said I would handle it on my own but I think they did because they doubled my initial offer
