I have someone calling me saying they are filing a civil court against me for a car loan back in *
Hello **** ****, to better assist you, I need to know which U.S. state you reside in as laws vary from state to state. Additionally, were you officially served with a lawsuit or is this just a verbal claim?
Texas and they claim they sent a letter by certified mail in dec i never got and only juts called me today and told me about it
In Texas, you must be served a lawsuit. If you haven't received a lawsuit:
- You could ask for proof of the certified mail.
- The statute of limitations for car loans in Texas is 4 years. If it's been more than 4 years, they may not be able to sue.
They say since its a bank its federal and denton county approved it. But again it was in * and i have not gotten anything. Could this be fraud?
It's possible. Consider these steps:
- Request proof of the lawsuit and certified mail receipt.
- Check if the statute of limitations has passed.
- If you suspect fraud, report to your local law enforcement and Federal Trade Commission.
- Consult a lawyer for further advice.
Thanks
