I recently purchased a used vehicle from Nuway auto November 9th, i didnt even have the vehicle a full * hours and it left me an my 5 month old daughter broke down on the side of the road. Nuway kept giving me the run around saying that I had to get the vehicle to their shop but the vehicle would not move at all. They kept telling me they would call me back and they never did. I called everyday for 7 days and they finally got a wrecker to come get it. Now they are wanting me to pay $* out of pocket to get it fixed. I could understand if I had the vehicle long enough to put wear and tear on it but i didnt. I drove it from the car lot straight home, and then tried to go to the store the next morning and it broke down. I need to find out what can be done about this.
I'm sorry to hear about your situation, ****. In Mississippi, there's a law called "Implied Warranty of Merchantability". This law implies that:
- The vehicle should be fit for the ordinary purposes for which such goods are used.
- The vehicle should be adequately contained or packaged.
- The vehicle should conform to the promises made on the container or label.
However, used cars are generally sold "as is", meaning you take on the risk for any problems. Please check your sale agreement to see if any warranties were included.
It does not state that the agreement is as is and I do have a limited warranty with the vehicle
If your agreement includes a limited warranty, the seller must honor it. You can file a complaint with the Mississippi Attorney General's Office if they don't. Remember to keep all your documents, such as the agreement and any communication records.
They want me to pay $* out of my pocket to get it fixed.
If the issue with your vehicle is covered by the limited warranty, you should not be required to pay $* for repairs. If the dealership refuses to honor the warranty, consider filing a complaint with the Mississippi Attorney General's Office.
Could the dealership put me in a different vehicle
The dealership may agree to put you in a different vehicle, but it isn't legally obliged. If the warranty covers your situation, they need to repair your car or refund you. If they don't, consider filing a complaint with the Mississippi Attorney General's Office.
