Car Purchase Contract Dispute

Summary

If a car dealer in Missouri changes contract terms after signing, the new contract typically replaces the old one. If the second loan fails, the dealer may ask for the cars return. If your trade-in is sold, they could owe you its value. Consult a local attorney for specific advice. Contact the Missouri Bar Associations Lawyer Referral Service for attorney recommendations.

In mo I went to buy a car i notice after i sign the purchase agreement contract that the terms had changed in that they added on extra s i did not ask for. they also changed the price stated for the car. I came back and they had me a new contract with a new lender with all new terms.Does the 1st contract survive if the second one does not go through?
Hello Vickie, the legal principle of contract modification may apply here. In general:
- If a new agreement is signed, it typically replaces the old one.
- Failure of the second contract may not necessarily revive the first contract.
Please consult a local attorney for specific advice.
but since I already have the new car and if the 2nd loan dont go through then hes already sold my trade will i get to keep this car since he cant give me my sold car back
In Missouri, if the 2nd loan doesn't go through, the dealer may ask for the return of the car. However, if they can't provide your traded car, they could potentially owe you the trade-in value. Consult with a local attorney to understand your rights.
can you recommend an attorney. I find it hard to get a lawyer to take this case because its not worth the small amount to make off of it. Ive been turned down by every lawyerr so far
I'm sorry to hear about your difficulties, Vickie. While I can't recommend a specific attorney, I suggest contacting the Missouri Bar Association's Lawyer Referral Service. They can help connect you with an attorney suitable for your case.
