This is actually ****’s mother Patricia Mcneely. She is a single hardworking woman. I’m trying to help her out. Here’s the situation, back in April of this year my daughter purchased a *.*-*.* cellphone from Amazon. When it arrived only the charger no phone was in the box. She immediately called Amazon and they told her to file a police report and it was treated as a theft. After a short time Amazon turned over the claim to Affirm who my daughter Amy’s for purchases monthly. They have turned over the debt to a collection agency and it’s ruined her credit already. She doesn’t want to pay for something she doesn’t have. If it would have been $*.* she would have paid and been done with it. Any advice would greatly appreciated.
Hello Patricia. I understand the situation is frustrating for ****. Could you please tell me where you are located? The laws regarding consumer protection can vary by location, and I want to ensure I provide the most accurate information.
Greenwood Indiana
Hello Patricia. In Indiana, **** can:
- File a complaint with the Indiana Attorney General's Consumer Protection Division (*-*-*-* or www.in.gov/attorneygeneral)
- Consult an attorney if the amount is significant
It's important to keep all relevant documents and records.
She already did that and they have been no help, she hasn’t heard anything from them since August
I'm sorry to hear about your struggle. If you haven't done so already, **** may wish to consider taking legal action. Small claims court in Indiana handles cases up to $*,*. Alternatively, she may want to consult with a consumer rights attorney for further advice.
Does it cost to present a claim?
Yes, filing a claim in Small Claims Court in Indiana does involve a filing fee. The fee can range from $* to $* depending on the county. However, if **** wins, she might be able to recover this cost.
Thank you for your time I will pass this information along to my daughter.
