Summary
Driving schools in Alabama must follow state regulations and provide agreed-upon instruction. If services are not rendered properly, a consumer complaint can be filed with the Alabama Attorney Generals office. Statements about being untrainable may be unprofessional and discriminatory, potentially violating the ADA if related to disabilities. Consulting an attorney familiar with ADA laws is advisable for further guidance.Full Conversation
She did refund me( gave me * of the * back), and I did contact the Alabama attorney office and made a consumer complaint but I just want to know if this situation ethical in a lawyer perspective because she basically called me incapable of driving because she said I am untrainable and the school cannot teach based on my learning ability which I think is a violation of ADA( Americans with disabilities act). I don’t have a disability but someone else that may take her lessons may have a disability and she showing discrimination
Hey Ebony, it sounds like a tough situation. In terms of ethics and legality:
- Ethical Concerns: Statements about being "untrainable" can be seen as unprofessional and potentially discriminatory, especially if they are based on assumptions about learning abilities.
- ADA Violation: The ADA protects against discrimination based on disabilities. If the statement was discriminatory towards someone with a known disability, it might be a violation.
Seeking further legal advice from an attorney familiar with ADA laws could be beneficial. Would you like help connecting with a local lawyer who can offer more detailed guidance?
