I’m facing eviction. I’m in California. I received the courtesy notice saying that somebody is pursuing eviction for in my county. I was told that a summons could come any day. If my summons comes Wednesday, Thursday or Friday, do you know what days I would have to respond by?
Hello ****, in California:
- If you're served with an eviction summons, you have 5 days to respond if served in person.
- If it's left with another person or mailed, you have 15 days.
So if served on Wednesday, you'd respond by the following Monday.
.
Hello ****,
That's correct. Please note that these are business days, so weekends and court holidays are not counted in the 5 days. You should file your response with the court as soon as possible to avoid any issues.
if weekends aren’t counted, then shouldn’t be due by Wednesday of the following week to be within the five days
Hello ****,
You're correct. If you're served on a Wednesday, and considering that weekends are not counted, you should respond by the following Wednesday to be within the * business days.
