We live in a RV park in Gonzales county Texas. We have been served with a 3 day vacate and the park owners are threatening to just pull my RV out of the park on the 3rd day which is tomorrow. The owners are saying that it is legal for them to do this because they run the park like a motel and that makes us guess instead of tenants but I believe that we are tennis because we have been here for a little over 2 years do they have a right to do that or is there anything I could do to get them not to do that
Hello ****,
In Texas, eviction laws may differ depending on whether you're considered a tenant or a guest. However, even if the RV park is run like a motel, the period of your stay may grant you certain rights.
- Texas Property Code Sec. *.* states that your landlord can't remove your belongings or deny you access without a court order.
- A tenant who has stayed for an extended period, like your 2 years, might be seen as a 'tenant at will', offering you certain protections.
You should consult a lawyer for specific advice.
We can't afford an attorney at this moment the reason we're being evicted is because we can't afford we didn't come up with this month's rent we do our own lawn service business and with all the localized rain and weather we have not had that much business come in so it's been kind of a little rough for the last couple months
I understand your situation, ****. Here are some options:
- Texas Law Help provides free legal information.
- Lone Star Legal Aid offers free services to low-income people.
- Legal aid centers can help mediate or negotiate with your landlord.
Remember, you have rights even if you're unable to pay rent.
Is there anything I can get from the courthouse to do a stay of eviction or something so they can't just yank my RV out of the park
Yes, ****. You can file for a 'Stay of Eviction' at your local courthouse, which temporarily halts the eviction process. It will buy you some time to negotiate with your landlord or find another place to live. You can also look into 'Emergency Rental Assistance Programs' in Texas.
I'm not even sure that they have filed an eviction with the courthouse because there's suspecting to be able to just do the guest deal for the that they're saying they could do since they don't consider us tenants but could I go ahead and get this day of eviction without them having father eviction notice
It's possible to file for a 'Stay of Eviction' even if an eviction notice hasn't been formally filed. However, it's best to check with your local court in Gonzales County, Texas to understand the exact process. Remember, laws may vary, so it's crucial to get correct local information.
