my grandfather passed away January *. He had fallen and had a fractured vertebrae and ribs and was in the hospital, then placed into a skilled nursing facility rehabilitation. He was *% OK except for his physical injuries but within a matter of * to * hours he went from walking, talking, eating to being almost in a stroke like state, and we found out. He had aspiration pneumonia, and no one on the staff could explain why or how he got in this position we found him in a diaper a T-shirt, no blanket, nothing at the end of the hall by himself, and within * hours he passed away I’m wanting to know if I still have the means to pursue a case against the facility and the workers who neglected to do their job, and how to acquire the information as far as documentation to know who was in charge at that time
Did you or any family member report this incident to the management of the nursing facility or any local authority at the time?
I was sick with Covid. My aunt is the one who found him in that state she did notify them. They act clueless, but after I’ve sat on this for this time, it just doesn’t feel right, knowing that they got away with Aiden and his death.
Did your aunt or any other family member document the condition in which they found your grandfather?
yes, we did, and he was transported to a Hospital where he later passed away
What documentation or evidence do you currently have regarding your grandfather's condition and the alleged neglect at the nursing facility?
we have photo evidence and clear statements from the staff that they didn’t know who his nurse was at the time they didn’t know how he ended up in that position, and we have documentation from the hospital showing his condition
Did you or your family consult with a medical expert to determine if the nursing facility's actions or lack thereof directly led to your grandfather's condition?

In Louisiana, medical malpractice cases require expert testimony to establish negligence.
